Restoring a National Treasure
Originally part of the Museum of Fine Arts in Wrocław, the painting was lost during WWII and later resurfaced in Winterthur, Switzerland. It was acquired in 1986, restored in 1987, and, after negotiations, was set to be returned to Poland in 2024. Our role was to ensure its safe importation and delivery to the National Museum in Wrocław.

Repatriating artwork is a complex process requiring precision and strict adherence to national and international regulations. We managed the entire process, from documentation to customs clearance, in close coordination with the Ministry and transport company to ensure a smooth operation.
Handling the Customs Clearance
We handled the importation under Customs Procedure 40 00, which applies to non-EU goods entering the EU, granting them EU status upon meeting legal and regulatory requirements. The painting was classified under HS Code 9701210000, indicating it as a handmade painting over 100 years old. The clearance process required thorough documentation, including authenticity certificates from Swiss authorities and the Polish Ministry, and was aligned with the EU’s cultural goods exemption, ensuring no customs duties were owed.
Navigating Legal and Procedural Complexities
The return of the painting involved legal intricacies, including a repatriation agreement between two governments. Our team’s specialized knowledge of both Polish and international regulations ensured compliance, particularly regarding the cultural goods exemption under EU legislation.
A Smooth and Safe Transition
From the moment the painting was handed over in Winterthur, we ensured it was carefully packaged, insured, and transported directly to the National Museum in Wrocław, minimizing delays and potential barriers.
